World. These Terms of Use govern your use of Golf Rental World (the
"Site") and the Golf Rental World service and sale of products (the
"Service"). These terms and conditions describe the rules
that apply to your use of the Site. Golf Rental World may change these
terms and conditions at any time; any such changes will be posted in this
section of the Site and will be effective at the time of posting. Please
check this section of the Site before using the Site to determine whether a
change has been made to these Terms and Conditions. If you do not agree
with any of the changes made to the Terms and Conditions please discontinue use
of the Site and Service and contact us by email at support@golfrentalworld.com or toll free 1-866-300-5909 to terminate
your account. By using this website you agree to the current version of
the Terms and Conditions as well as the Privacy Policy. Please review our

Conditions of Use
By using this site, you signify your
agreement to the following conditions of use without limitation or
qualification. Please read these conditions carefully before using this site.
GolfRentalWorld.com may at any time revise these terms and conditions by updating
this posting. You are bound by any such revisions and should therefore
periodically visit this page to review the then current terms and conditions to
which you are bound.
If you return a product in a damaged condition that exceeds normal
wear and tear, as determined by Golf Rental World in its sole discretion, you
agree that Golf Rental World may charge your credit card and collect a
replacement fee for such product (except to the extent the loss is covered by
insurance you may have purchased from Golf Rental World to cover damage to the
product). The product replacement fee varies depending on the specifics of each
individual club or set. You may purchase insurance at the time you order a
product. The applicable insurance fee varies depending on the
product.PLEASE MAKE SURE THAT YOU CHECK OFF THE CLUB CHECKLIST AND RETURN
THIS WITH THE CLUBS.
Rental Period
The
Rental Period is defined as that period of time, which shall be no less than
one (1) day, for which you have reserved to rent golf equipment from Golf
Rental World Inc. The Rental Period will start the first day of your rental
period and commence by the next morning. The golf clubs will be picked up at
9:00am the day after your rental period is over. Failure in having the golf
clubs ready for pick up will incur a 1 day rental rate,that will be charged to
your credit card.
Rental Delivery and Pickup directions
Golf Rental World will deliver rental clubs to your designated delivery
location that you assigned in the shipping checkout. We will only deliver to a
location that is open 24/7, and will require a signature from a person
authorized to accept delivery. Golf Sets will arrive the afternoon before you
play. Please make sure that the golf clubs are packaged correctly and left at
the front desk or shipping/receiving department of the hotel. If the golf clubs
are being picked up from a golf course please leave them at the pro shop. If the golf clubs are being delivered to a
private residence then someone will need to be home to sign for the golf clubs.
This person must be over 18 years of age. We will not pick up golf clubs from a
private residence so please drop them off at the closest FedEx Kinko’s. There
will directions included in your welcome package to the closest FedEx Kinko’s
from the private residence. The golf clubs must be dropped off no later than
12:00 pm.
Subject to Availability
The Company will make all reasonable efforts to provide the
Renter with the Rental Equipment the Renter desires. However, please note that
due to unknown factors such as Rental Equipment not being returned on time,
insufficient lead time, lost or stolen Rental Equipment, etc., all Rental
Equipment is subject to availability. If the Rental Equipment reserved is
unavailable, the Company will contact the Renter to determine if alternative
Rental Equipment is acceptable to the Renter. In the event it is not, a
full refund will be processed.
Reservation Changes and Extension of Rental Period
The Company will make all reasonable efforts to make any
changes that the Renter may wish to make to the Renter’s reservation, including
any extensions they may wish to make to the “Rental Period” (defined below).
Please note, however, that any such changes are subject to availability,
particularly when requested within 3 business days or less of the First Rental
Day.
Damaged or Missing Golf Club Policy
In the event that you do not receive your
clubs by the designated delivery time, or if any of the clubs are missing or
damaged, you must contact customer service (1-866-300-5909) to notify us of the
problem. Golf Rental World will do our best to accommodate the situation.
In the event that any of the equipment is not returned to us, lost, stolen,
broken or in the event that any of the returned equipment is in a state of
damage that exceeds normal wear and tear, as determined by us in its sole and
absolute discretion, you expressly authorize that we may immediately make a
charge to your credit card in the amount of the replacement cost for such lost,
stolen, broken or damaged item(s). You hereby authorize us to charge your
credit card in the amount of our cost to replace such damaged or missing
item(s), plus all other fees incurred, such as, but not limited to, shipping
and handling costs. We have no duty to mitigate our replacement cost(s),
including any attempt to fix or find such damaged or missing item(s).
Gift
Certificates and Promotional Offers
Golf Rental World offers various Gift Certificates that can be applied toward
the Service. You authorize us to charge your credit card for any Gift
Certificates that you purchase. Gift Certificates are also subject to the
additional terms and conditions set forth on the "Gift Subscriptions"
page. All promotions are also subject to the additional terms and conditions
set forth on the "promotions" page.
Cancellations
The Renter may cancel this Agreement at any time at
least 3 business days prior to the “First Rental Day” by calling the Company’s
customer service phone number. Reservations canceled less than 3 business days
prior to the First Rental Day will charge a $25.00 cancellation fee. There will
be no exceptions.
Billing
When you rent from us you will be required to provide Golf Rental World with
accurate, complete and current credit card information for a valid credit card
that you are authorized to use. By signing up for the Service, you authorize
Golf Rental World or its agent to bill your credit card the applicable
membership fees, per-item or rental fees, shipping charges, any and all
applicable taxes, and any other charges you may incur in connection with your
use of the Service. The applicable rental fees will be charged to your credit
card on the date your rental is shipped.If Golf Rental World does
not receive payment from your credit card provider or if your credit card
expires or is rejected, you agree to pay all amounts due upon demand. Golf
Rental World reserves the right to take all steps necessary to collect amounts
due from you, including but not limited to using third party collection
agencies. Golf Rental World reserves the right to correct any errors or
mistakes that it makes even if it has already requested or received payment.
We reserve the right to determine whether
your credit card is pre-authorized to accept a minimum charge equal to your
membership fee and the current retail value of the product/products rented.
All applicable local, city, and state
taxes are your responsibility. You agree to pay these taxes.
You are solely responsible for any and
all fees charged to your credit card by the issuer, bank, or financial
institution including, but not limited to, membership, overdraft, insufficient
funds, and over the credit limit fees. You agree to notify us about any billing
problems or discrepancies within 90 days after they first appear on your
account statement. If you do not bring them to our attention within 90 days,
you agree that you waive your right to dispute such problems or discrepancies.
We may modify the price, content, or
nature of the Service at any time. If we modify any of the foregoing terms, you
may cancel your membership. We may provide notice of any such changes by
e-mail, notice to you upon log-in, or by publishing them on the Site.
Submissions
The Site may allow you and other third parties to post reviews or comments
concerning the Service or the products we distribute. Any opinions, advice,
statements, services, offers, or other information that constitutes part of the
content expressed or made available by third parties on the Site are those of
the respective authors or producers and not of Golf Rental World, or its
shareholders, directors, officers, or employees. Golf Rental World may review
and delete any content, in whole or in part, that in the sole judgment of Golf
Rental World violate these Terms of Use or which might be offensive, illegal,
or that might violate the rights of or harm any third parties. Nonetheless,
under no circumstances will Golf Rental World, or its shareholders, directors,
officers, directors, or employees be held liable for any loss or damage caused
by your reliance on information obtained through the Site. It is your
responsibility to evaluate the information, opinion, advice, or other content
available through the Service or the Site.
We are free to use any comments,
information, ideas, concepts, reviews, or techniques or any other material
contained in any communication you may send to us (each, a
"Submission"), including, without limitation, responses to
questionnaires or through postings on message boards on the Site without
further compensation, acknowledgment or payment to you for any purpose
whatsoever including, but not limited to, developing, manufacturing and
marketing products and creating, modifying or improving the Site and the
Service. Furthermore, by posting any Submission on the Site, submitting
information to us, or in responding to questionnaires, you grant us a
perpetual, non-exclusive, fully paid, royalty-free, irrevocable, sub license
able, worldwide license and right to display, use, perform, reproduce, modify,
distribute and create derivative works of the Submission or information
submitted in any media, software, or technology of any kind now existing or
developed in the future. By posting or providing a Submission or information,
you represent and warrant that public posting and use of your Submission or
information by Golf Rental World will not infringe on or violate the rights of
any third party.
Be advised that we do not accept
unsolicited materials or ideas for use or publication, and are not responsible
for the similarity of any of our content to materials or ideas transmitted to
us. Should you send any unsolicited materials or ideas, you do so with the
understanding that no additional consideration of any sort will be provided to
you, and you are waiving any claim against us and our affiliates regarding the
use of such materials and ideas, even if material or an idea is used that is
substantially similar to the idea you sent.
Disclaimers of Warranties; Limitations on Liabilities
The Service (including the products
provided under the Service or purchased through the Site), and the Site and its
contents, are provided "as is"; Golf Rental World makes no
representations or warranties of any kind with respect to the Service, gift
certificates, products provided with or sold by the Service, the Site, or any
contents therein. Golf Rental World assumes no liability or responsibility for
any errors or omissions in providing the Service or in the content of the Site,
any failures, delays, or interruptions in the shipment of products, delivery of
any content contained on the Site, any losses or damages arising from the use
of the content provided on the Site, goods or services provided by Golf Rental
World, or any conduct by users of the Site. Golf Rental World reserves the
right to refuse to ship products in its sole discretion. GOLF RENTAL
WORLD EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES RELATING TO
THE SERVICE, THE PRODUCTS, AND THE SITE, INCLUDING, BUT NOT LIMITED TO,
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY,
ACCURACY, AUTHENTICITY, TITLE, AND NON-INFRINGEMENT. In addition, Golf Rental
World does not represent or warrant that the information on or accessible via the
Site or through the Service is complete or current.
GOLF RENTAL WORLD AND ITS AFFILIATES',
SUPPLIERS', AND THEIR RESPECTIVE OFFICERS', DIRECTORS', SHAREHOLDERS',
EMPLOYEES' AND AGENTS' LIABILITY UNDER THESE TERMS OF USE AND ANY OTHER TERMS
AND CONDITIONS (INCLUDING GIFT CERTIFICATE TERMS AND CONDITIONS) IS LIMITED TO
DIRECT, OBJECTIVELY MEASURABLE DAMAGES. GOLF RENTAL WORLD AND ITS AFFILIATES,
SUPPLIERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES
AND AGENTS WILL NOT BE HELD LIABLE FOR ANY INDIRECT OR SPECULATIVE DAMAGES
(INCLUDING, WITHOUT LIMITING THE FOREGOING, CONSEQUENTIAL, INCIDENTAL, AND
SPECIAL DAMAGES) INCLUDING, BUT NOT LIMITED TO, LOSS OF USE, BUSINESS
INTERRUPTIONS, AND LOSS OF PROFITS, REGARDLESS OF WHETHER THESE PARTIES HAD
ADVANCE NOTICE OF THE POSSIBILITY OF ANY SUCH DAMAGES. GOLF RENTAL WORLD AND
ITS AFFILATES', SUPPLIERS', AND THEIR RESPECTIVE OFFICERS', DIRECTORS',
SHAREHOLDERS', EMPLOYEES' AND AGENTS' TOTAL LIABILITY TO YOU FOR ANY CLAIM
ARISING OUT OF OR RELATING TO THE SERVICE, THE PRODUCTS, GIFT CERTIFICATES, THE
SITE OR THESE TERMS OF USE, WHETHER IN CONTRACT OR IN TORT, SHALL NOT EXCEED
THE AMOUNTS PAID TO GOLF RENTAL WORLD BY YOU UNDER THESE TERMS OF USE. EACH
PROVISION OF THESE TERMS OF USE THAT PROVIDES FOR A LIMITATION OF LIABILITY,
DISCLAIMER OF WARRANTIES, OR EXCLUSION OF DAMAGES IS TO ALLOCATE THE RISKS
UNDER THESE TERMS OF USE BETWEEN THE PARTIES. THIS ALLOCATION IS REFLECTED IN
THE PRICING OFFERED BY GOLF RENTAL WORLD TO YOU AND IS AN ESSENTIAL ELEMENT OF
THE BASIS OF THE BARGAIN BETWEEN THE PARTIES. EACH OF THESE PROVISIONS IS SEVER ABLE AND INDEPENDENT OF ALL OTHER PROVISIONS OF THIS AGREEMENT. THE
LIMITATIONS IN THIS SECTION WILL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL
PURPOSE OF ANY LIMITED REMEDY IN UNDER THESE TERMS OF USE. Some states do not
allow the foregoing limitations of liability, so they may not apply to you.

Rental World. All Golf Rental World graphics, logos, page headers, button
icons, scripts and service names are trademarks or trade dress of Golf Rental
World. Any trademarks not owned by Golf Rental World that appear on the Site
are the property of their respective owners, who may or may not be affiliated with,
connected to, or sponsored by Golf Rental World. All content and compilation
thereof on the Site, including, but not limited to, text, graphics, logos,
designs, photographs, button icons, images, data compilations, and software, is
the property of Golf Rental World, its licensors, or its product suppliers, and
is protected by United States and international copyright laws. No material,
including, but not limited to, the material listed above, should be reproduced
or used without our express written permission. You may download,
print, or forward a copy of the material on this website only for personal,
